What are defects?
Resolving defects that appear in the first 12 months after the completion of a building
This section does not apply to non new-build properties except where there is some unexpired warranty (see ‘Extended warranty’ below).
A problem is a defect only if it arises through faulty workmanship or materials. Defects may include unconnected drainage pipes, however, they do not include the replacement of a filter on a cooker hood, or improvements.
Builders have to resolve defects that appear in the first 12 months after the completion of a building, not from the date of your purchase. This is known as the ‘defects liability period’. If defects appear within this 12 month period, please let us know as soon as possible.
If the builders are responsible for a defect, we will get them to rectify it. If you are responsible, you will have to pay for repairs and maintenance. Your home will be inspected at the end of the ‘defects liability period’ along with neighbouring properties built at the same time.
You may want to prepare a list of defects in advance and you may be asked to confirm all defects by signing a list. Do not sign if all the defects are not listed. If defects are not identified during this period, they can only be dealt with under the warranty (see ‘Extended warranty’ below).
Extended warranty
Newly built homes also benefit from the National House-Building Council (NHBC) warranty, Building Life Plans Claims (BLP) or similar. This warranty is in the form of an insurance policy and is effective after the first 12 months from when the property is built. NHBC cover is up to 10 years and BLP cover is up to 12 years. Your solicitor acting for you in your purchase will normally supply a copy of the NHBC certificate to you and your mortgage lender, and they may keep a copy in your file.
